Great win today in the published decision, In re Marriage of Schlundt and Fillingame, 2021COA58. The Court of Appeals ruled in our favor that the endangerment standard applies when a change of a majority-time parent is requested as a sanction under C.R.S. section 14-10-129.5, an issue of first impression. Even better, the court determined that the lower court's finding of endangerment was erroneous and that the evidence did not support a finding of endangerment. Client was pro se at trial, and the court was very hostile toward her. So happy for my client and so happy to see the lower court held accountable for its errors!!
